Claims for Lost and Damaged Shipments

The causes of loss and damage are:

 

Within the network
By related agents - co courier, OBC, Railways
Theft and pilferage
Natural calamities - earthquakes, cyclones, flood
Force majeure (events beyond our control) - fires, accidents, riots, embargo
Carelessness - improper handling, lack of protection against rain, improper stacking at the hub
Improper packaging - This could be an oversight on the part of the consignor or the personnel at the Hub / Branch and could lead to not only that particular consignment but also other consignments too getting damaged.

We also provide a comprehensive insurance coverage to our customers through which the value of a lost or damaged consignment can be indemnified. This is ‘Automatic Risk Coverage’ . All claims are processed through M/S National Insurance Company Limited. A customer has to pay the surcharge as applicable for the automatic risk coverage.

Insurance Procedures

Some basic requirements:

Declaration of value on the consignment note is mandatory. Incase, of the no declared value being mentioned on the consignment note and no extra premium being charged at the time of booking as per policy. FFCL’s liability shall be restricted to Rs. 5000/- only in case of documents and Rs. 10,000/- only, in case of non-documents. The following points have to be taken into account at the time of booking a consignment to make it eligible for compensation in case of loss / damage.

 

At the time of booking cash non-documents - the value of the shipment should be mentioned in the declared value column and this amount should tally with the corresponding invoice value.
While booking credit non-documents - the invoice should carry the applicable insurance charge, as per the terms and conditions. The insurance charged also needs to be mentioned on the bill being raised against the client.

Paperwork Requirements

Incase of loss consignment:
An FIR should be lodged immediately at the place where the consignment is lost and the original FIR copy should be forwarded to corporate office. Corporate office in turn will intimate ‘National Insurance Company’.

For settlement of the claims related to loss in addition to the FIR the following Original papers should be taken from the consignor and forwarded to corporate office.

a) Consignment copy
b) Consignor’s claim letter
c)

An understanding letter addressed to ‘National Insurance Company Limited, XIX, Turner Morrison Building, 3rd Floor, 16 Bank Street, Fort, Mumbai - 23” from the consignor stating that the consignment was not insured under marine insurance policy

d) Invoice copy / Declaration copy (in case of non-documents)

In case of damaged consignments:

In case of damage, a survey is to be conducted with the aid of the local National Insurance Company unit locally. After the survey, the survey report is to be sent to corporate office. The claim is settled at the corporate office after receipt of all the papers from the origin.


Points to be noted:

Consequential losses cannot be claimed. The value of the lost or damaged shipment can be claimed. However, any claim by the consignor against telephone calls, travel, mental harassment cannot be entertained, as this is not directly related to the value of the goods. .

All papers are required in original. Xerox copies are not accepted in lieu of the originals. After three reminders, if no response is received, corporate office shall be closing the case.

FIR should reach corporate office within two months of consignment lost otherwise the case will be closed by the National Insurance Company stating “no claim”.

4. Claims are to be made within 90 days from booking of consignment. The company beyond this period of ninety days, shall entertain no communication. Further, the consignor shall have to furnish all relevant papers in support of his claim.

Processing of the claim may take between fifteen to thirty days after receipt of ‘complete paperwork’ at corporate office. On receipt of all papers (including the FIR in case of lost shipments and ‘Survey Report’ incase of damaged shipments) at the corporate office it is forwarded to ‘National Insurance Company Limited’ Mumbai for the settlement of claim. National Insurance Company then appoints a surveyor who surveys the case and gives his report. The claim is settled according to the report submitted by the surveyor.

Excess clause - Claims below and up to Rs. 1000/- should be settled at the regional office in consultation with the Regional Head.
