Risk Coverage
Automatic Risk Coverage is ensured for documents and parcels limited to actual loss or Rs. 5,000/- and Rs. 10,000/- respectively, whichever is less. Consignor shall not be entitled for a claim, if he holds a marine policy.
Automatic Risk Coverage Surcharge shall be applicable for non-documents valued over Rs. 10,000/-. Non-documents valued between Rs. 10,001/- to Rs. 20,000/- shall be charged Rs. 10/- and an additional Rs. 10/- for every multiple of Rs. 10,000/- or part thereof, up to a maximum limit of Rs. 100,000/-. Value limit of acceptance is Rs. 100,000/-.
For contracted clients, the same risk surcharge shall prevail and should be settled at the time of bill settlement. Claims, if any, shall be settled within 60 days from the date of receipt of evidence of expenditure and other paperwork to include
a) a letter of claim
b) consignor copy
c) declaration / invoice copy
d) an undertaking from the client that he has no marine policy.
Circumstances beyond our control
We shall make every reasonable effort to deliver your consignment according to our normal delivery schedule, but we are not liable if a consignment is lost, damaged, delayed or mis-delivered because of circumstances beyond our control. These include:
Act of God for example earthquake, cyclone, storm or flood
Force major for example war, plane crash or embargo
Any action or mission by anyone outside First Flight, for example The sender of the consignment, the receiver of the consignment, an interested third party, Customs or other Government officials, the postal service, other carrier or third parties that we contract to serve locations that we do not serve directly. We are not liable even if the sender did not asked for or know about third party arrangements.
We are also not liable for electrical or magnetic damage to, or erasure of electronic or photographic images or recordings, damages on account of handling in transit.
Consequential damages
We are not liable for the following, whether they arise in contract or any other form of civil action including negligence.

Consequential damages or losses include, but we are not limited to, lost income, profits, interest, markets and loss of contracts / Goodwill.
Warsaw Convention
If the transportation of a consignment involves an ultimate destination or stop in a country other than the country of departure, the Warsaw convention may apply. The convention governs, and in, most cases it further limits our liability or damages to such consignments*.
*Note: Warsaw Convention: Refers to Convention for the unification of rules regarding the international transportation of goods by air. This document was signed in Warsaw on October 12, 1929 and was updated in Montreal in 1975.
Under the Warsaw Convention, the forwarder should always issue his AWB as soon as goods come into his care, even if they are to be held in a warehouse until an import license has been granted. As far as Air Cargo is concerned, most Air Waybills are drafted so that they can be used for both domestic and international transportation. As such, they contain the standard Warsaw Convention clause:
If the carriage involves an ultimate destination or stop in a country other than the country of departure, the Warsaw Convention may be applicable and the convention governs and in most cases limits the liability of the carrier in respect of loss, damage or delay to 250 French gold francs per kilogram, unless a higher value is declared in advance by the shipper and a supplementary charge paid if required. (Emphasis added).
Proof of Delivery:
First Flight is not committed to give a Hard copy of POD.
Compensation:
You may agree that we may settle your claims in the following manner as decided by First Flight on case-to-case basis.
A free of cost delivery / or replacement / reconstruction of consignment
Cheque payment of settlement amount
Non-deliverable consignments:
First Flight does not take any responsibility whatsoever for service failure (i.e. delay / non delivery). If you book a consignment without telephone / fax numbers / improper address / incomplete address further in case, a consignment is non deliverable for nay reasons attributable to you and reasons beyond our control you authorize us to treat them as decided by First Flight on case to case basis.
Abandon the consignment
Mail by the local postal mode from nearest transit point
You further agree to pay the additional correction / distribution / RTO charges towards problem arising to First Flight on non-deliverable consignment due to mistakes accounted by you.
Dutiable goods:
In case the goods booked by you attracts duties at the destination airport, the same is payable by the receiver. First Flight is not responsible for any delay or otherwise due to non co-operations of the receiver. However, additional charges as given below and as decided by First Flight on case-to-case basis would be collected from the receiver in advance before clearing the consignment from customs.

If the receiver refuses to pay the above, you agree to pay us the same. Further any liabilities arising out of this such as confiscation of goods, legal proceedings or otherwise by respective authorities etc. would be purely on account of the receiver and you.
Disputes:
In all cases jurisdiction of India will prevail.
